The State Service of Geology and Subsoil of Ukraine is not going to comply with the Supreme Court's decision either voluntarily or under the writ of execution, which they are appealing.
On 28.02.2024, the State Service of Geology and Subsoil filed an appeal against the decision of the Kyiv District Administrative Court of 09.02. 2024, which decided to issue a writ of execution to PrJSC MC Ukrnaftoburinnya in case No. 2a-7778/09/2670, obliging the State Service of Geology and Mineral Resources of Ukraine to reconsider the application of PrJSC MC Ukrnaftoburinnya for a special permit for oil production, gas, condensate (commercial development) at the Sakhalin oil and gas condensate field, as well as to consider the application for the conclusion of an agreement with PrJSC MC Ukrnaftoburinnya on the terms of subsoil use, which is an integral part of the special permit.
In order to leave the state-owned company without a special permit, the State Service of Geology and Subsoil is ready to violate the law that establishes the binding nature of court decisions in Ukraine and provides for criminal liability for their non-enforcement.
As a reminder, yesterday we reported that the Kyiv District Administrative Court issued a writ of execution obliging the State Service of Geology and Subsoil of Ukraine to reconsider the application of PrJSC MC Ukrnaftoburinnya for a special permit for oil, gas, condensate (industrial) and gas, condensate (commercial development) at the Sakhalin oil and gas condensate field, as well as to consider the application for entering into an agreement with PrJSC MC Ukrnaftoburinnya on the terms of subsoil use, which is an integral part of the special permit.
